Tuan Le, "of Atlanta," according to this weekend's Washington Times, is accused of having smashed Nguyen Quoc Huy in the face last June 21, in the course of a protest at the Willard Intercontinental Hotel here in Washington. Le is the son of "a black U.S. soldier who was killed in action during the Vietnam war." He came to this country in 1993 from Vietnam and is a legal permanent resident. Huy is the vice chairman of the prime minister's office of Vietnam.

Le's lawyer, Kenneth Robinson, plans to present "a possible psychiatric defense," because he was tortured as a child in Vietnam. Among other things, Robinson says, Le was ordered to dance by Communist soldiers. When he refused, "the soldiers stuck bayonets through the backs of his heels." Le didn't walk for a year. And, still according to Robinson, some of Hy's security guards recognized Le and taunted him.

Le may be facing deportation from a court system that apparently has to find him insane or punish him. To which my question is, who's crazy here? Le seems to me to have taken reasonable, albeit somewhat undiplomatic, action. To call him insane seems totally nuts to me. Isn't he entitled to hit the guy in the face? But then, I'm not a lawyer…

IS AMERICA CLINTONED OUT?

Barack Obama did not blow apart Hillary Clinton's huge lead during the 2008 Democratic primaries just because he was a landmark African-American candidate, new to the scene, and a skilled campaigner. Even Democrats were all Clintoned out.

By such weariness, I don't suggest that either of the Clintons is unpopular. Indeed, Americans apparently look fondly back on the high-growth 1990s as the continuation of the Reagan-Bush boom years, and a time when Democrats and Republicans finally fixed budget deficits.

(Note well that when Obama went back to the Clinton-era tax rates for the more affluent, the deficit dipped, but certainly did not approach the balanced budget that was once achieved by spending discipline under the Clinton-Gingrich compromise.)

The problem instead is Hillary Clinton herself. She is not a very good speaker, and is prone to shrill outbursts and occasional chortling. She has a bad habit of committing serial gaffes (e.g., speaking too candidly), and what she says on Monday is often contradicted by her rantings on Tuesday.

She seems cheap and obsessed with raking in free stuff. When Bill steps in to correct her mistakes, either sloppily or out of some strange psychological spite, he usually makes things even worse. We saw that often in 2008 and are seeing it again now. But aside from the cosmetics of her political style, the Clintons are faced with two fundamental obstacles in 2016.

Have you noticed that many government regulations are so complex and vague that it is impossible to know if you are in compliance?

Examples are the 70,000-plus pages of Internal Revenue Service regulations and the reported 30,000-plus pages of Obamacare regulations. Who do you think has a self-interest in all this complexity and vagueness?

The Food and Drug Administration was set up to protect us from consuming bad food or drugs. It has morphed into an agency that keeps potentially beneficial drugs from us, and now is even banning our ability to know what diseases to which we may be prone, and thus, blocking our ability to take potential corrective or preventative action.

The FDA has gone from being a protector to a destroyer of health and liberty. Other overreaching government regulators are also squeezing liberty out of existence. Here are some examples.

SHALE GAS IS REARDEN METAL

For my summer holidays I have been mostly reading Atlas Shrugged. Ayn Rand has her faults but, boy, was she prescient. She wrote it back in the 1950s.

One of the things she foresaw was the current nonsensical, dishonest, canting campaign against shale gas. In Atlas, it takes the form of Rearden Metal, the miracle technology which is going to transform the US economy if only the progressives will let it. But of course, Rand's fictional progressives don't want Reardon Metal to succeed any more than their modern, real-life equivalents want shale gas to succeed.

Why not? For the same rag-bag of made-up, disingenuous scare-mongering reasons which progressives have used to justify their war on progress since time immemorial: it's unfair, it uses up scarce resources, it might be dangerous.

As they are attempting to do now in Britain's West Sussex, and have succeeded in doing in New York.

THE TRAITOR IN THE WHITE HOUSE

This past weekend I had a private dinner with three Congressmen. I can't tell you who they are, other than one is the chairman of a powerful committee, the second the chairman of another major committee, the third a freshman. I can't tell you where the dinner took place either.

Ostensibly, we gathered to discuss threats to national security such as Islamic terrorism, Iran, Pakistan support for the Afghan Taliban, and the Chicoms. After we got into this for a while, I decided to see what would happen if I said what I really wanted to say:

"Fellas, what about the single greatest threat to America's national security, far greater than anything else? That's the traitor in the White House."

I expected them to recoil in shock and dismay, but they didn't blink an eye. All three nodded grimly in agreement.

OBAMA IN GREECE

If you could bring the playwrights of Ancient Greece - Sophocles, Aeschylus, Euripides, Aristophanes - from 5^th century Athens to watch the Democrat primary race of today, they would recognize it instantly. It is a perfect Greek tragedy.

All the incredible amounts of money being spent, all the frantic energy and hysteria, the entire swirling maelstrom created by a vast cast of characters - all of it is for naught, for there can be only one outcome, an inescapable outcome of doom.

The old playwrights would scoff at our naïve notions of free will, our arguments that each of the participants in the tragedy - such as the "superdelegates" - really do have the capacity to act for themselves.

No, they would say, the characters have no choice, for no matter what they do, they are drawn into a trap of ineluctable fate, like a fly caught in a web of invisible silk strands, so invisible he doesn't know he's caught while the spider approaches.

The 5^th century Greeks would have understood the play. A 4^th century Greek would understand what happens to the audience watching the play.

FRYING PANS AND FIRES

We've all heard the expression "Out of the frying pan and into the fire," to go from bad to worse than bad. The question of the moment in America is: Will that be what voters do on November 7?

Congress's summer recess ended this week, with Congressistas, Senatorials, and their staffers flooding back into town. The mood on Capitol Hill is not upbeat.

The Pubbies know what a lousy job they've done, the Demmies terrified the voters will figure out they are a lousy alternative. That's why the electorate is in such a lousy mood: Let's see, frying pan or fire?

An example of how demoralized conservative Republicans are in Congress was the shouting match that took place this morning during the GOP Caucus, a weekly meeting of all Republicans in Congress.

SOME JIHAD!

Bit by bit, we are getting a fuller picture of our enemies on the ground in the Middle East, and the fanciful legend of a bunch of religiously inspired fanatics is eroding. If only someone could convince our so-called intelligence agencies to step away from their false assumptions (Porter Goss was on display last week, babbling about the "Sunni insurgency," as if that nonsense had not been exploded 30 years ago), we might make more progress.

We are engaged in a regional war against a terror network that cannot be reduced to a simple ethnic or religious element. The network is bound together by a common hatred of us and our friends and allies, not by a single religious fanaticism, and the terrorists come in all shapes and descriptions.

Their effectiveness is largely due to support from the terror masters in foreign countries, and we cannot win the battle of Iraq without destroying the terror masters in Tehran, Damascus, and Riyadh. There is no escape from this destiny. If they survive, we lose.

It isn't going to gain any territory. Israel isn't going to withdraw from Ashkelon or Sderot under a hail of rockets.

So if Hamas can't win, why is it fighting?

OBAMA PACKS THE COURT

If you have ever been before a judge for any reason, did you think about whether the judge was appointed by a Democrat or a Republican?

Probably not. People expect judges, regardless of political leanings, to be fair and competent -- and for the most part, this expectation has been fulfilled in America, unlike many other places in the world.

The action by the Senate Democrats last week, though, to kill the long-standing agreement that required a 60 percent supermajority vote for the confirmation of a federal court judge (with the exception of the Supreme Court) and change to a simple majority vote causes many to fear the increased politicization of the federal judiciary.

The immediate cause of the Senate action in changing its rules appears to be the desire of the Obama administration to appoint three new federal judges to the U.S. Court of Appeals for the District of Columbia Circuit. This court is often viewed as the most important appellate court, in part because many of the cases involving alleged federal government overreach go to that court.

That's why Obama wants to "pack" it with liberal judges.

THE SURVEILLANCE STATE MONSTER AND WHAT TO DO ABOUT IT

There's really no more doubt about it, the US government is a Surveillance State, far beyond any East German autocrat's wildest dreams. And it is far, far more dangerous to us than Al Qaeda.

We all come from a background that taught us that the Soviet Union and its totalitarian empire was horrifying (which it was), and that the USA was good, noble and pristine. That makes it hard for us to accept that the US has now become what East Germany once was. We keep looking for reasons to not to believe it.

So what now? Your first move is to protect yourself. There's no use in saying much against a surveillance state while they're listening to your every word. There are two ways to protect yourself:
